After you finish the online interview, we will mail you all of the documents you need to file your divorce — completely filled out and ready to sign.

We use the official Florida forms approved by the Florida Supreme Court. You will receive the following completed documents:

  • Florida Petition for Divorce
  • Summons
  • Florida Answer & Waiver

  • Notice Social Security Number

How long does a Florida divorce take? Florida does not have a mandatory waiting period for finalizing your divorce, but a judge may delay the case up to three months to allow you to reconcile. The DivorceWriter™ documents and instructions allow you to complete your divorce as quickly as is legally possible.
Are court filing fees included with my purchase? No.  Each county in Florida charges a filing fee when you file your petition.  Please check with your local county courthouse to determine fees. What is the process for filing our Florida Divorce?

STEP 1: Filing Your Petition

Review and sign the documents.

  • Bring the Petition, Summons, and filing fee to the county courthouse.
  • The Clerk will keep one copy of your Petition and will “file stamp” your other two copies showing the date and time you filed your petition.

STEP 2: Serving Summons

Even though you are working on this divorce together with your spouse, you need to prove to the court that your spouse has received the petition.

  • Mail your spouse a “file stamped” copy of the Petition and Summons.
  • Your spouse signs a Waiver.
  • File the waiver with the court.

STEP 3 : Finalizing Your Divorce

The settlement agreement is the most important part of your divorce. This is the contract you and spouse will sign agreeing to how your property will be split and any issues regarding children.

  • Have both you and your spouse sign the settlement agreement.
  • File the agreement and official judgment notice to the court.
  • Once your Decree is signed by the judge, your divorce is final.
