How long does a North Carolina divorce take?

Before you can file for divorce in North Carolina, you need to have lived separate and apart from your spouse for at least one year.

What's an "Absolute Divorce"?

North Carolina has two types of divorce: Divorce from Bed and Board and Absolute Divorce. A divorce from bed and board is essentially a legal separation; neither spouse is free to remarry after a divorce from bed and board. However, an Absolute Divorce ends the marriage permanently.

Are court filing fees included with my purchase? No.  Each county in North Carolina charges a filing fee when you file your divorce.  The filing fees vary, but typically are in the $135 range.  If you cannot afford the filing fee, you may be eligible to have the fee waived (your clerk can provide details).
Do both of us have to go to Court? No. only the Plaintiff has to attend the court hearing.
How long can we take to complete the online interview? You can take as long as you need to complete the online interview.  With your divorce purchase you are given a password protected account allowing you to access it at any time.  When you have completed the online interview to your 100%, select the "Submit for Printing" button.
Can I make changes after receiving the printed documents? Yes. If you entered something incorrectly, or your circumstances have changed requiring updates to your documents, you can make the changes from your account and we will reprint your documents at no additional charge.

What is the process for filing our North Carolina Divorce?

STEP 1: Filing Your Petition

Review and sign the documents.

  • Bring the filing fee and the Divorce Complaint to the clerk's office.
  • Schedule a hearing

STEP 2: Serving Your Spouse

After you have filed the divorce complaint, you need to serve the Complaint on your spouse with the included Civil Summons. After handing the forms to your spouse, your spouse must sign the Acceptance of Service document.

STEP 3 : Finalizing Your Divorce

Only the person, who filed the petition, has to go to the court hearing.

  • Bring the Judgment document to your scheduled hearing time.
  • Hearings are typically brief. Answer any questions the judge may have. Included in instructions is some sample testimony.

Once your Judgment is signed by the judge, your divorce is final.
